Stryker Hip Lawsuit News: Centralization of Federal LFIT V40 Femoral Head Claims to Be Addressed at March 30th Hearing, Bernstein Liebhard LLP Reports


NEW YORK, March 6, 2017 /PRNewswire/ -- The U.S. Judicial Panel on Multidistrict Litigation (JPML) will hear Oral Arguments regarding a petition to centralize all federally-filed Stryker hip replacement claims alleging injury due to LFIT Anatomic CoCr V40 Femoral Heads at its March 30th Hearing Session in Phoenix, Arizona. According to an Order issued by the JPML on February 14th, oral arguments on this and other matters are to commence at 9:30 a.m. (In RE: Stryker Orthopaedics LFIT V40 Femoral Head Product Liability Litigation, MDL NO. 2768)

Stryker issued an "Urgent Medical Device Recall Notification" to surgeons in August2016, warning that certain LFIT V40 Femoral Heads had been associated with  a higher-than-expected number of complaints involving taper lock failure.  Taper lock failure has the potential to cause a range of debilitating complications, including:

In November 2016, the U.S. Food & Drug Administration (FDA) designated Stryker's notification a Class II recall. This classification indicates that a device may cause temporary or medically reversible adverse health consequences.

In January, plaintiffs pursuing Stryker hip lawsuits involving LFIT V40 Femoral Heads filed a petition with the JPML to centralize all federally-filed cases in a single U.S. Disrict Court for coordinated pretrial proceedings. At the time, six cases were already pending in various federal courts. However, plaintiffs asserted that the litigation had the potential to include thousands of similar claims, and argued that centralization would "promote the just and efficient conduct of these actions." They have suggested that the docket be transferred to the U.S. District Court, District of Massachusetts, were three claims involving the LFIT V40 femoral head recall are already moving forward.

Multidistrict litigations are intended to improve judicial efficiency through the avoidance of duplicative discovery and inconsistent court rulings, and to preserve the resources of the court, parties and witnesses. Centralization would thus allow all federally-filed Stryker hip lawsuits involving LFIT 40 Femoral Heads to undergo coordinated pre-trial proceedings, including discovery and motion practice.
