New Brunswick Southern Railway Sentenced Under the Transportation of Dangerous Goods Act Following Guilty Pleas


SAINT JOHN, NB, April 18, 2019 /CNW/ - New Brunswick Southern Railway Company Limited (NBSR) was sentenced today following guilty pleas in Saint John Provincial Court to 2 counts for offences under the Transportation of Dangerous Goods Act.

The Court ordered the company to pay a total of $10,000 in fines and $40,000 for the implementation of research programs in the field of safety standards under the Transportation of Dangerous Goods Act and its Regulations.  Corrective measures were implemented by NBSR at the onset of the investigation in 2014 and dangerous goods training has been provided to employees.

NBSR was charged in 2017 after an investigation revealed that they did not comply with all applicable safety requirements by transporting dangerous goods which were not accompanied by all documents required under the Regulations. The company also failed to adequately train its employees in the transportation of dangerous goods, thereby committing an offence contrary to the Act.

These offenses occurred over an eight-month period (November 2012 to July 2013) during which approximately 6853 cars transported residue of petroleum crude oil for Irving Oil Commercial GP.

The regulations established under the Transportation of Dangerous Goods Act focus on the protection of the environment and the physical safety of people and property.

The Public Prosecution Service of Canada is responsible for prosecuting offences under federal jurisdiction in a manner that is free of any improper influence and that respects the public interest. The PPSC is also responsible for providing prosecution-related advice to law enforcement agencies across Canada.
